Galax Circuit Court Records

The Galax Circuit Court is the city's trial court of general jurisdiction. It handles all felony criminal matters filed in the city, grand jury proceedings, and appeals from the General District Court. Galax is an independent city under Virginia law, meaning its court system is wholly separate from Carroll and Grayson counties. The court is assigned to the 27th Judicial Circuit. The Circuit Court Clerk holds all felony case files for Galax including indictments, warrants, sentencing orders, plea agreements, and case dispositions. These records are public absent a sealing order from a judge.

You can search Galax Circuit Court criminal records online through the CJISWeb system operated by the Virginia Judicial System. On the search page, select Galax City from the locality list. Then search by party name, case number, or hearing date. Criminal cases carry a "CR" prefix in the case number. The database reflects entries made by the clerk's office, so it generally shows current case status. This is the fastest way to check on a case without visiting the courthouse.

Document copies from the clerk's office cost $0.50 per page. Certified copies require an additional $2.00. Triple-seal certifications add $2.50 more. Normal office hours run 8:30 AM to 4:30 PM, Monday through Friday. If you have a complex request or are looking for older archived records, call ahead before you visit.

The General District Court in Galax handles misdemeanor criminal charges, traffic violations, and preliminary hearings for felony cases before they move to the Circuit Court. Civil claims up to $25,000 also fall within its jurisdiction. There are no jury trials at this level. All cases are decided by a judge. Criminal Record Access in Galax

Court case files in Galax are open public records. The Circuit Court Clerk's office allows inspection and copying during business hours. Court records are distinct from criminal history records maintained by law enforcement. Under Virginia Code section 19.2-389, criminal history records held by the state are regulated separately and are managed by the Virginia State Police rather than the local clerk. Court files at the clerk are open to anyone who wants to look at them. State-level criminal history records require more formal access procedures.

For records held by the Galax city government outside the court system, you can make a request under the Virginia Freedom of Information Act. FOIA requires a response within five working days from public bodies. Criminal investigative files can take up to 60 additional working days under section 2.2-3706.1. The Virginia FOIA Advisory Council offers guidance on filing requests and understanding which records are available or exempt from disclosure.

For statewide criminal background checks, the Virginia State Police processes requests through vsp.virginia.gov. The CCRE covers arrests and dispositions from all Virginia courts and jurisdictions, not just Galax.

Record Sealing for Galax Cases

Virginia's sealing law at Title 19.2, Chapter 23.1 allows certain criminal records to be removed from public view. If your Galax case was dismissed, acquitted, or nolle prossed, you may be able to petition under section 19.2-392.2 to have those records sealed. Once sealed, the case is removed from online case information systems. Certain offenses named in section 19.2-392.12 cannot be sealed under any circumstances. DUI and domestic assault are among the most common ineligible offenses.

Starting in July 2026, Virginia's expanded sealing law will allow people with certain qualifying convictions to petition for sealing after completing waiting periods free of new convictions. This process is not automatic. You must file a petition at the Galax Circuit Court and meet each requirement in the statute. The Virginia Courts Self-Help Center provides free forms and step-by-step guides for people who want to pursue sealing without hiring an attorney. Given Galax's smaller court system, the process may move more quickly than in larger jurisdictions.

Self-Help and Legal Resources

The Virginia Courts Self-Help Center is a free online resource maintained by the Virginia Judicial System. It covers records requests, sealing petitions, responses to criminal charges, and general court procedures across all Virginia courts. The guides are written for people who are handling their own legal matters without an attorney.

Galax residents who need legal help with criminal matters may be able to access legal aid from organizations serving the Southwest Virginia region. Mountain Empire Legal Services and similar groups provide free assistance to qualifying residents based on income. The Self-Help Center links to these organizations, and the Virginia State Bar also has a lawyer referral service if you need paid representation. Southwest Virginia's court systems can be remote and harder to access for some residents, so using online resources first is strongly encouraged.

The Virginia FOIA statute gives you the right to ask the Galax city government for records beyond what the court clerk holds. Use this when you need police incident reports or other city records. For criminal court case filings, start with the free CJISWeb and GDC portals online, then visit the clerk's office at 200 N Main Street if you need hard copies or certified documents.
