Online Search Tools for Poquoson Records
Virginia's free court portals cover Poquoson the same as any other city in the state. The OCIS 2.0 statewide system allows you to search across General District Courts, Juvenile and Domestic Relations Courts, and select Circuit Courts at the same time. This is useful when a person may have cases in Poquoson and also in neighboring York County or Hampton. All three systems are free and do not require an account to use.
The Virginia Judicial System case status portal is the best starting point. It links all the search tools together and also explains what each system covers. You can also subscribe to the Case Alert Subscription System (CASS) for free text or email notifications when specific Poquoson cases are updated. For most routine records searches, the online portals are sufficient and save a trip to the courthouse.
Note: Juvenile records, sealed records, and certain domestic case data are excluded from all public search portals regardless of which tool you use.
Criminal Record Access in Poquoson
Criminal case records held by the Poquoson Circuit Court Clerk are generally open to the public. Virginia Code § 19.2-389 covers criminal history records at the state level through the Central Criminal Records Exchange (CCRE), which is a separate system maintained by the Virginia State Police. Court clerk records and CCRE records are distinct. Clerk records cover court proceedings. CCRE records are a law enforcement database of arrests and dispositions reported by agencies statewide.
If you need records from the Poquoson city government or police department, you submit a request under the Virginia Freedom of Information Act. A public body must respond within five working days. Requests involving criminal investigative files can take up to an additional 60 working days. The Virginia FOIA Advisory Council provides free guidance if a request is denied or goes unanswered. For statewide background checks, contact the Virginia State Police directly.
Record Sealing and Expungement
Virginia's record sealing laws apply to Poquoson residents. Under Virginia Code Title 19.2, Chapter 23.1, a person whose charge was dismissed or who was acquitted can petition the Poquoson Circuit Court to seal those records under § 19.2-392.2. Not all cases qualify. Section 19.2-392.12 lists offenses that are ineligible, including certain serious misdemeanors and most violent felony convictions.
Virginia's broader sealing law for qualifying convictions takes effect in July 2026. At that point, people with certain misdemeanor and felony records may petition for sealing after completing waiting periods and meeting other criteria. The process requires filing a petition with the Circuit Court and is not automatic. The Virginia Courts Self-Help Center provides forms and step-by-step guidance for people pursuing sealing of Poquoson criminal records.
Self-Help and Legal Resources
The Virginia Courts Self-Help Center is the main free resource for Poquoson residents who need to handle court matters without an attorney. It covers how to request records, file petitions, respond to criminal charges, and understand court procedures at both the Circuit Court and General District Court levels. The site is maintained by the Virginia Judicial System and applies to all Virginia courts.
Poquoson is a small city surrounded by larger jurisdictions. Legal aid organizations serving the Hampton Roads peninsula, including Legal Aid Society of Eastern Virginia, may be able to help qualifying residents with criminal matters. Contact information is available through the Self-Help Center. Because Poquoson is small, many routine records requests can be handled by phone or through the online portals rather than an in-person visit.
Note: Poquoson and York County share the 9th Judicial Circuit. If you are searching for records related to activity that spans both jurisdictions, search both Poquoson City and York County separately in the online portals.
