The Hampton General District Court handles misdemeanor criminal charges, traffic offenses, and preliminary hearings for felony cases. It also holds civil jurisdiction for claims up to $25,000. There are no jury trials at this court level. Defendants who want a jury trial must appeal to the Circuit Court, where the case starts fresh under the de novo standard.

General District Court records are searchable online through the GDC online system. Select Hampton City from the court selector. You can look up cases by party name, case number, or hearing date. The system also allows online payment for some fines and traffic costs. The court is open Monday through Friday, 8:30 AM to 4:30 PM.

Preliminary felony hearings take place here before a case moves to the Circuit Court. These hearings are part of the public record. The Juvenile and Domestic Relations Court handles matters involving juveniles separately and those records carry stronger confidentiality protections.

Criminal Record Access in Hampton

Court records on file with the Circuit Court Clerk are open to the public under Virginia law. The Virginia Freedom of Information Act, codified at Virginia Code Title 2.2, Chapter 37, sets the rules for requesting records from public bodies in the city. Under FOIA, a public body must respond within five working days. Some categories of criminal investigative files can take up to 60 additional working days.

The Virginia FOIA Advisory Council offers guidance on records requests and helps people understand their rights when seeking public records. If you need records from Hampton's city government rather than the courts, direct your FOIA request to the appropriate city department. Hampton's website at hampton.gov has department listings and contact information.

For full criminal history records, the Virginia State Police maintains the Central Criminal Records Exchange (CCRE). You can request a background check or personal record through vsp.virginia.gov. The CCRE covers arrests and dispositions statewide and is separate from what the local court clerk maintains. Under Virginia Code section 19.2-389, access to criminal history information is regulated and limited to authorized requesters in most cases.

Record Sealing in Hampton

Virginia law allows sealing of certain criminal records. Under Virginia Code Title 19.2, Chapter 23.1, dismissed charges and acquittals may be eligible for sealing under section 19.2-392.2. This removes the record from public-facing systems, including online court portals. Not every charge qualifies. Serious offenses listed under section 19.2-392.12 are excluded even if other criteria are met.

A broader sealing law takes effect in Virginia in July 2026. This law will allow people with certain convictions to petition for sealing after waiting periods are met. The process is not automatic. You must file a petition and meet the statutory requirements. If you are not sure whether you qualify, the Virginia Courts Self-Help Center has forms and step-by-step guides to help you start the process.

Self-Help and Legal Resources

The Virginia Courts Self-Help Center provides forms, guides, and plain-language instructions for people handling court matters without a lawyer. It covers how to request records, respond to criminal charges, file petitions, and understand court procedures. The site is maintained by the Virginia Judicial System and applies to all Virginia courts, including Hampton's.

Hampton is part of the Hampton Roads metro area and has access to legal aid organizations that serve the region. These programs assist low-income residents with criminal matters, FOIA requests, and record sealing. You can find contact information through the Self-Help Center or by reaching out to the Virginia State Bar referral services. The Hampton Police Division at hampton.gov/146/Police-Division can also point you to local resources if you need guidance on accessing arrest or incident records.

Note: Hampton is an independent city. It has no county government above it, so all local records for Hampton residents go through Hampton's own courts and city offices, not any surrounding county.
