Online Tools for York County Court Records
Virginia provides several free public tools for searching criminal court records. The OCIS 2.0 statewide system lets you search across multiple courts at once. This is useful when you are not sure which court handled a case or when you need to check several jurisdictions. For York County circuit-level cases, the CJISWeb portal is more targeted.
The Case Status and Information portal at the Virginia Judicial System website shows active case status, upcoming hearing dates, and party information. It covers both Circuit and General District courts. No account is needed. These tools are free and provide real-time data. Sealed records, juvenile cases, and certain domestic matters will not appear in these public searches.
Note: Online portals only show publicly available case data. For certified copies or full case files, contact the clerk's office directly.
Criminal Record Access in York County
Court records at the Circuit Court Clerk's office are generally open to the public. Under Virginia Code § 19.2-389, criminal history record information held by law enforcement is subject to specific release rules. Court case files are separate from those law enforcement records and are more broadly accessible. You do not need to show ID or prove a legal interest to view most criminal court records at the clerk's office.
For records from York County government itself rather than the courts, you submit a FOIA request through York County's FOIA process at yorkcounty.gov/foia. The Virginia Freedom of Information Act, found at Virginia Code Title 2.2, Chapter 37, requires a public body to respond within five working days. Criminal investigative files may take up to 60 additional days in some circumstances. The Virginia FOIA Advisory Council provides guidance and assistance for requesters statewide.
The Virginia State Police maintains the Central Criminal Records Exchange (CCRE). For statewide background checks, visit vsp.virginia.gov. This covers arrests and dispositions from all Virginia jurisdictions, not just York County.
Record Sealing and Expungement
Virginia allows certain criminal records to be sealed. Under Virginia Code Title 19.2, Chapter 23.1, dismissed charges may be eligible for sealing under § 19.2-392.2 if the case was dropped or if the person was acquitted. Not all offenses qualify. Certain serious crimes listed under § 19.2-392.12 are excluded from sealing even when other criteria are satisfied.
A major expansion of Virginia's sealing law takes effect in July 2026. At that point, people with certain qualifying convictions may petition to seal those records. The process is not automatic. You must file a petition, meet all statutory requirements, and receive a court decision. The Virginia Courts Self-Help Center has guides and forms to help you understand your options and get started with the petition process.
Self-Help and Legal Resources
The Virginia Courts Self-Help Center is a free resource for people who need to work through the court system without a lawyer. It covers how to request records, respond to criminal charges, file petitions, and understand court procedures. The site applies to all Virginia courts, including York County's Circuit and District courts.
York County sits near several major cities on the Peninsula, including Williamsburg, Newport News, and Hampton. Legal aid organizations in those areas often serve York County residents.
